SARFAESI enforcement<\/h3>\n\n\n\n<p>The SARFAESI Act, 2002, lets eligible lenders enforce security and recover dues without going to court, by issuing notice and taking possession of the secured asset. But NBFCs have to meet three conditions for this route:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>NBFC status:<\/strong> Must be centrally notified as a financial institution, requiring an asset size of \u20b9100 crore or more<\/li>\n\n\n\n<li><strong>Debt threshold:<\/strong> \u20b920 lakh or above per loan facility, down from \u20b950 lakh since 2021<\/li>\n\n\n\n<li><strong>Security type:<\/strong> Loan must be backed by tangible collateral; unsecured loans don&#8217;t qualify at all<\/li>\n<\/ul>\n\n\n\n<p><strong>Best fit:<\/strong> A secured loan of \u20b920 lakh or more, where the NBFC itself is asset-size-eligible and centrally notified.<\/p>\n\n\n\n<p><strong>Limit:<\/strong> For most small-ticket lenders, this route fails twice over. The process itself can take three months to play out: Accounts must be 90 days overdue and classified as NPA before you can act. Section 13(2) notice gives the borrower 60 days to repay or object. If they object, you must respond with reasons within 15 days before proceeding further.<\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\">3.
